Terms of Service

These terms are the agreement between you and US Logistics Consultants LLC, which operates Feed Your Vitality ("we," "us," or "our"). They cover this website, our email and text programs, our books, and our newsletter subscriptions. By using the site or buying anything from us, you accept them.

1. Who may use this site

You must be at least eighteen years old and able to enter a binding contract. If you are using the site on behalf of a company, you are telling us you have the authority to bind that company to these terms.

2. Our content and your license

Everything on this site and in our books, newsletters, emails, and other materials, including text, design, graphics, logos, and the names Feed Your Vitality and The Vitality Letter, belongs to us or to the people who licensed it to us, and is protected by copyright and trademark law.

You may read our content, print a copy for yourself, and quote short passages with attribution. You may not republish it, sell it, put it behind your own paywall, use it to train a machine learning model, or reproduce it in bulk without written permission. Ask us. We are reasonable about this.

3. Joining the pre-launch list

Putting your name on the book launch list is not a purchase and does not obligate you to buy anything. It means we will email you before the book is released and tell you the founding price and when the door opens.

We intend to honor the founding price for people on the list on launch day, as described on the page where you signed up. If circumstances force that to change, we will tell you in advance rather than quietly changing the offer.

4. Orders and pricing

Prices are in US dollars and do not include tax or shipping unless we say so. We may change prices at any time, but a change never applies to an order you already placed.

Your order is an offer to buy. We accept it when we send you a confirmation or ship the item. We may refuse or cancel an order, including after confirmation, if the item is unavailable, if there was an error in the price or description, or if we suspect fraud. If we cancel an order you already paid for, you get a full refund.

We try to describe things accurately. Typos happen. An obvious pricing error is not an offer we are bound to honor.

5. Shipping and delivery

We ship physical products, including books and the printed newsletter, to the address you give us. Getting that address right is your job. Delivery estimates are estimates. Risk of loss passes to you when the carrier takes possession.

If something arrives damaged or does not arrive at all, tell us within thirty days and we will make it right.

6. Subscriptions and renewals

The Vitality Letter is a paid subscription. Here is exactly how it works:

• It bills automatically on a recurring basis at the price and interval shown when you subscribe, using the payment method you provide, until you cancel.
• By subscribing, you authorize us to charge that payment method on each renewal.
• You can cancel at any time from your account or by emailing us. Cancel before the next renewal date and you will not be charged again.
• Canceling stops future issues and future charges. It does not retroactively refund issues already printed and mailed, except as described in section 7.
• If we change the price, we will tell you before it takes effect and you will have the chance to cancel first.
• Because each issue is physically printed on a schedule, there is a cutoff each month. Subscribe or cancel after the cutoff and the change applies to the following issue.

7. Refunds and our guarantee

Any specific guarantee stated on the page where you bought something is part of these terms and controls if it is more generous than what follows.

Absent a stated guarantee: physical products may be returned within thirty days in resalable condition for a refund of the purchase price, less shipping. Digital products are refundable within thirty days of purchase. Subscription refunds are handled as described in section 6.

To start a refund, email us. You do not need a reason, and we are not going to make you justify yourself.

8. Email and text messages

By giving us your email address, you agree to receive email from us. Unsubscribe any time using the link in any message.

If you provide a mobile number and consent to texts, message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Consenting to marketing texts is not a condition of buying anything. Our Privacy Policy explains how we handle your number, which is: we do not share it.

9. Acceptable use

Do not use this site to break the law, infringe anyone's rights, send spam, upload malicious code, scrape or harvest data by automated means, attempt to gain unauthorized access to any system, or interfere with the site working properly for other people.

10. Health disclaimer

Before you change how you eat, start or change how you exercise, or act on anything you read here, talk to your physician or another qualified health provider. That goes double if you are pregnant or nursing, are over sixty-five, take prescription medication, or have or suspect any medical condition, including heart disease, high blood pressure, diabetes, an eating disorder, or a musculoskeletal injury.

Never disregard professional medical advice or delay seeking it because of something you read from us. If you think you are having a medical emergency, call your doctor or 911 immediately.

We cite published research where we make factual claims. Research is not a personal recommendation. Studies describe averages across populations; you are one person with your own history, and general findings may not apply to you.

You take part in anything we describe voluntarily and at your own risk. By using our materials you accept full responsibility for your own health decisions and their outcomes.

11. No guaranteed results

We make no promise about what will happen to your health, your energy, your calendar, your relationships, or your career. Any story, example, or case we share describes what happened for one person under their circumstances, and is not a promise that the same thing will happen to you. Results depend on factors we do not control, starting with what you actually do.

12. Third-party links

We link to books, research, tools, farms, and other businesses we think are worth knowing about. We do not control them and are not responsible for their content, products, or practices. A link is not an endorsement of everything a company does. Where we have a financial relationship with someone we recommend, we say so.

13. Disclaimer of warranties

The site and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error free, or that the content is complete, current, or accurate.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of your use of the site or our materials, even if we were told such damages were possible.

Our total liability for any claim relating to the site, our content, or a product is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless US Logistics Consultants LLC and its owners, officers, and contractors from any claim, loss, liability, or expense, including reasonable legal fees, arising out of your use of the site, your violation of these terms, or your violation of anyone else's rights.

16. Termination

We may suspend or terminate your access to the site or to any list or subscription at any time, with or without notice, if you breach these terms or if we stop offering the service. Sections that by their nature should survive termination do survive it, including sections 2, 10, 11, 13, 14, 15, and 17.

17. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Orange County, CA, and you consent to their jurisdiction.

Before filing anything, email us and give us thirty days to fix it. Most problems are a misunderstanding and a refund away from being solved.

If any provision of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it.

18. Changes to these terms

We may update these terms. The effective date at the top tells you when they last changed. Significant changes will be announced by email or by notice on the site. Continuing to use the site after a change means you accept the revised terms. Changes never apply retroactively to an order already placed.
